A meeting of the Transportation Committee/Committee of the Whole was held in the Board Room, Administration Building, Toll Plaza, San Francisco, California, on Thursday, December 7, 2006, at 10:00 a.m., Chair Brown presiding.

1. Report of the District Advisory Committees
       
  a. Advisory Committee on Accessibility
       
   

The agenda for the November 16, 2006, meeting and the minutes of the October 19, 2006, meeting of the Advisory Committee on Accessibility (ACA) were furnished to the Transportation Committee. Copies are available in the Office of the District Secretary and on the District’s web site.

  b. Bus Passengers Advisory Committee
       
   

There was no meeting of the Bus Passengers Advisory Committee in November 2006; therefore, no meeting materials were furnished to the Transportation Committee.

  c. Ferry Passengers Advisory Committee
       
   

A Notice of Meeting Cancellation for the November 1, 2006, meeting of the Ferry Passengers Advisory Committee was furnished to the Transportation Committee. Copies are available in the Office of the District Secretary and on the District’s web site.

Approve Actions Relative to the Award of Contract No. 2007-MD-4-RTCC (CCCTA No. 2007-MA-01-RTCC), Ultra-Low Sulfur Diesel and Unleaded Gasoline
       
 
In a memorandum to Committee, Deputy General Manager/Bridge Division Kary H. Witt, Deputy General Manager/Bus Division Susan C. Chiaroni, Deputy General Manager/Ferry Division James  Swindler and General Manager Celia Kupersmith provided staff’s recommendation relative to the award of Contract No. 2007-MD-4-RTCC (CCCTA No. 2007-MA-01-RTCC), Ultra-Low Sulfur Diesel and Unleaded Gasoline.   The report stated that the Divisions listed below project the following annual usage:
  1) Bus Division:
1,579,826 gallons of Clear Ultra-Low Sulfur Diesel Fuel (ULSD) and 20,000 gallons of regular unleaded gasoline;
  2) Ferry Division: 1,580,000 gallons of Red ULSD; and,
  3) Bridge Division:
6,000 gallons of Clear ULSD, 50,000 gallons of Red ULSD and 65,000 gallons of mid-grade gasoline.
       
 

The report also stated that in an effort to obtain the best pricing, the District, as a member of the Regional Transit Coordinating Council of the San Francisco Bay Area (RTCC), participated in the joint procurement of this commodity. Central Contra Costa Transit Authority (CCCTA) was the lead agency for the fuel procurement. On October 16, 2006, CCCTA, on behalf of the RTCC, opened sealed bids from eight bidders in response to its Bid Invitation No. 2007-MA-01-RTCC. Bidders were informed that one or more contracts would be awarded based on the lowest responsive and responsible bid for each location and fuel type.

The report further stated that staff and the District’s Attorney have reviewed the bids and have determined that Redwood Coast Petroleum is the lowest responsive and responsible bidder for the Bus and Ferry Divisions. SC Fuels, the apparent low bidder for the Bridge Division, made a significant error in filling out the bid form, rendering SC Fuel’s bid nonresponsive. It quoted a bid for 89 Octane Fuel, but actually submitted a bid for 87 Octane Fuel, a product not requested by the Bridge Division. Therefore, staff and the District’s Attorney have determined that Falcon Fuels is the lowest responsive and responsible bidder for the Bridge Division. If approved by the Board, Golden Gate Petroleum (GGP), the vendor providing this commodity for these Divisions, will be replaced by these suppliers. Discussion ensued, including the following:

  • Director Reilly inquired as to how the bid prices for this contract were calculated, given the volatility of fuel prices. In response, Susan Chiaroni explained that the bid prices are based on the weekly average of prices in the Oil Price Information Service (OPIS) index. Ms. Chiaroni stated that the bidders have the option of setting their bid prices either a few cents higher or lower than the OPIS price. She further stated that staff checks the OPIS prices weekly to ensure that the successful bidder does not exceed the price range set in its bid.

Staff recommended and the Committee concurred by motion made and seconded by Directors STROEH/COCHRAN to forward the following recommendation to the Board of Directors for its consideration:

       
 
RECOMMENDATION
       
 

The Transportation Committee recommends that the Board of Directors approve the following actions relative to Contract No. 2007-MD-4-RTCC (CCCTA No. 2007-MA-01-RTCC), Ultra-Low Sulfur Diesel and Unleaded Gasoline:

  1.
Authorize award of Contract No. 2007-MD-4-RTCC to Redwood Coast Petroleum, Benicia, CA, for the provision and delivery of diesel fuel and gasoline in the approximate amount of $7,420,252.05 for the Bus Division and in the approximate amount of $7,265,472.00 for the Ferry Division;
  2.
Reject the apparent low monetary bid of SC Fuels for provision and delivery of diesel fuel and gasoline to the Bridge Division as nonresponsive; and,
  3.
Authorize award of Contract No. 2007-MD-4-RTCC to Falcon Fuels, Paramount, CA, for the provision and delivery of diesel fuel and gasoline in the approximate amount of $545,744.20 for the Bridge Division,
       
 

for a combined total estimated amount of $15,231,468.25, plus applicable taxes, for a two-year term commencing January 1, 2007, with three successive one-year options at the same terms and conditions exercisable by the General Manager or her designee; with the understanding that requisite funds are available in the FY 06/07 Bus, Ferry and Bridge Divisions’ Operating Budgets, and with the further understanding that requisite funds will be included in the appropriate future fiscal years’ Operating Budgets.

Monthly Report on Activities Related to Marin Local Service Contract with Marin County Transit District
       
  The monthly report on activities related to the Marin Local Service contract with the Marin County Transit District (MCTD) was furnished to the Transportation Committee. The report included the following elements:
  1.
A spreadsheet from the Planning Department providing statistics regarding GGT bus service performance of both District regional routes and MCTD local routes, for the month of October 2006; and,
  2.
A spreadsheet from the Auditor-Controller outlining the history of payments made to date by MCTD to the District for intra-county bus transit services in Marin County, under the new five-year Agreement with the MCTD for Marin Local Bus Service, which became effective on May 1, 2006.
       
 

Due to the high volume of agendas and minutes from Marin County agencies related to this item, hard copies of those items were not provided to the Committee. Instead, electronic versions of the following items were posted on the District’s web site:
