A meeting of the Governmental Affairs and Public Information Committee/Committee of the Whole (GAPI) was held in the Board Room, Administration Building, Toll Plaza, San Francisco, CA, on Friday September 24, 2010, at 9:45 a.m., Chair Reilly presiding.

Rescind the Authorization to Execute a Professional Services Agreement with Clearwire dba Clear Wireless, LLC, Relative to Request for Proposals No. 2010-BT-5, Wireless Internet Services Onboard Golden Gate Transit Buses, and Authorize Reissuing the Request for Proposals

In a memorandum to Committee, Marketing and Communications Director Kellee Hopper, Deputy General Manager/Administration and Development Z. Wayne Johnson, Deputy General Manager/Bus Transit Division and General Manager Denis Mulligan provided a report on staff’s recommendation to rescind the authorization to execute a Professional Services Agreement with Clearwire, dba Clear Wireless, LLC (Clearwire), Kirkland, WA, relative to Request for Proposals (RFP) No. 2010-BT-5, Wireless Internet Services Onboard Golden Gate Transit Buses; and, authorize reissuing the RFP.

The report stated that on August 18, 2009, the District issued RFP No. 2010-BT-5, for installation, operation and maintenance of wireless internet access on selected Golden Gate Transit bus routes. Among the benefits is the opportunity to appeal to potential riders who currently drive and to enhance the District’s ability to communicate with customers in the event of an emergency or significant impact to services. The District received one proposal from Clearwire. The staff report stated that Clearwire proposed to deliver internet access free of charge to the District and its passengers, and intended to have the high-speed 4G network available in the San Francisco Bay Area in late 2010.

The staff report indicated that, shortly after the Contract was awarded, Clearwire notified the District that hardware could not be provided at no cost, as previously agreed upon. Subsequently, Clearwire notified the District that provision of 4G coverage in the North Bay had been postponed indefinitely. A copy of the staff report is available from the Office of the District Secretary and on the District’s web site.

At the meeting, Ms. Hopper reported that staff had researched the possibility of acquiring the necessary hardware by other means. She stated that, given Clearwire’s inability to provide either the hardware or service agreed upon, staff recommends that the District rescind RFP No. 2010-BT-5 and authorize reissuance.

Staff recommended and the Committee concurred by motion made and seconded by Directors MOYLAN/STROEH to forward the following recommendation to the Board of Directors for its consideration:

RECOMMENDATION

The Governmental Affairs and Public Information Committee recommends that the Board of Directors rescind the authorization to execute a Professional Services Agreement with Clearwire, dba Clear Wireless, LLC, relative to Request for Proposals No. 2010-BT-5, Wireless Internet Services Onboard Golden Gate Transit Buses; and, authorize reissuing the Request for Proposals.
